Welcome to Kumkum Studio. These Terms of Service ("Terms") govern your use of our mobile application Kuration ("Kuration" or "Kumkum"), our website kumkumstudio.com ("Website"), and related services (collectively, the "Services"). By downloading the App, visiting the Website, or using any part of the Services, you agree to be bound by these Terms.
Please read these Terms carefully. They contain important information about your legal rights and obligations.
If you do not agree to these Terms, do not use (or continue to use) the Services.

The Services are provided "as is" and availability may be subject to maintenance, third-party services, and legal or technical constraints.
By creating an account or using the Services, you confirm that you have read, understood, and agree to these Terms. We may update these Terms from time to time for valid reasons (e.g. new features, legal requirements). We will post the updated Terms on this page and update the "Last updated" date. Where required by law, we may give you advance notice of material changes. Continued use after the change constitutes acceptance where permitted by law. If you do not accept the new Terms, you must stop using the Services.

Premium or other paid features may be offered via in-app purchase or subscription through the applicable app store (e.g. Apple App Store, Google Play). Payment, renewal, cancellation, and refunds are governed by the app store's terms and our stated offer. Unless otherwise required by law, purchases are generally final and non-refundable. We may change the scope or price of paid features with reasonable notice where allowed by law and app store rules.
You agree not to use the Services in any way that:
We may suspend or terminate access for conduct that we reasonably believe violates these Terms or is harmful to the Services or others.
Data you create in the app (e.g. collection names, favorites, saved artwork references) is stored to provide the service. You grant us the rights necessary to operate, store, and sync this data. We do not use this data for advertising profiling in a way that identifies you personally for third-party ads, and we do not sell it. Saving or organising Content within the app does not give you any ownership or licence to the underlying artwork, images, or narration beyond the limited use granted in these Terms.
The Services may contain links to third-party websites or use third-party services (e.g. sign-in with Google or Apple, ad networks, analytics). We are not responsible for the content, privacy practices, or terms of those third parties. We encourage you to read their policies before using them.
To the fullest extent permitted by applicable law: The Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Art identification and other automated features are for informational and entertainment purposes and may not be accurate or complete. We do not guarantee the correctness of identifications, stories, or translations.
To the fullest extent permitted by applicable law: Kumkum Studio (and its affiliates, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or, if you have not paid anything, fifty US dollars (USD 50) or the equivalent. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law (including mandatory consumer rights in your jurisdiction).
You agree to indemnify and hold harmless Kumkum Studio and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any third-party rights.
You may stop using the Services at any time; if you have an account, you may close it through the app or by contacting us. We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms. On termination, your right to use the Services ceases immediately. Provisions that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive termination.
If you have a complaint about the Services, please contact us at legal@kumkumstudio.com. We will endeavour to respond within a reasonable time. If you are a Consumer, you may have the right to use out-of-court complaint and redress schemes in your country. Except where prohibited by law, any dispute shall be governed by the law and courts specified in Section 16. For Consumers, mandatory rights under the laws of your place of residence remain unaffected.
These Terms and any non-contractual obligations arising from or in connection with them shall be governed by the laws of the United States (or, if you are in the European Union, the laws of an EU member state we designate), without regard to conflict-of-law rules. Where you are a Consumer, the mandatory consumer protection laws of your country of residence may apply. Subject to the above and to Section 15, the courts of the United States (or the EU member state we designate) shall have non-exclusive jurisdiction to settle any dispute.
Severability – If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Entire agreement – These Terms, together with our Privacy Policy and any in-app or store-specific terms we reference, constitute the entire agreement between you and Kumkum Studio regarding the Services. No waiver – Our failure to enforce any right or provision shall not constitute a waiver. Assignment – You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
